Article 1: Scope and modification of the general terms and conditions of sale

These general terms and conditions of sale (hereinafter referred to as “General Terms and Conditions”) apply to the relationship between IDH Switzerland – Guggenheim (hereinafter referred to as “IDH”) and all persons placing an order on one of the IDH websites (hereinafter referred to as the “Customer” or “Customers”).

IDH reserves the right to adapt or modify the General Conditions at any time, which will be immediately applicable to all new orders.

At the time of each order, the Customer must confirm that he/she has read and accepted the General Conditions. These Terms and Conditions apply to all orders placed by the Customer (hereinafter referred to as the “Order”).

Article 2: Products mentioned on the websites and Customer orders

The products visible on the Websites are for information purposes only and do not constitute offers from IDH. In particular, the photos appearing on the Website are not contractual.

All information provided on the IDH websites (product descriptions, illustrations and photos, films, dimensions, weights, technical specifications, accessories and other data) are provided for information purposes only and are in no way a formal guarantee of these characteristics. Only the manufacturer’s specifications are binding.

On the basis of this non-contractual information, the Customer may place an order for the product(s) displayed, exclusively by means of the procedure provided for by the Website and in compliance with the ordering procedures provided for on the Website. 

Any Order, once finalised according to the ordering process available on the Website, constitutes a firm offer to the Customer. The Customer decides to purchase the product displayed on the Website, under the conditions indicated by the latter.

For each Order, the Customer must indicate an e-mail address to which all communications from IDH in relation to the Order will be sent. It is the Customer’s responsibility to keep this address up to date and to take note of the emails sent by IDH. Any communication sent by IDH to the address indicated by the Customer will be considered as received by the Customer on the day it is sent. The risks of transmission and routing are assumed by the Customer.

The Customer may inform IDH, within 5 working days following the Order, of any change of delivery address. However, this change will only be taken into account if the Order has not yet been sent to the Customer. Otherwise, it is the Customer’s responsibility to take the appropriate measures to receive the Order at the delivery address indicated at the time of the Order.

Article 3: Validation of orders – firm and non-cancellable orders

In order to place an order, the customer must be 18 years of age or older and not under guardianship. The Customer ensures that all information provided is accurate and is therefore liable to IDH for any damage caused by inaccurate information. 

The Order placed by the Customer in accordance with article 2, above, constitutes a firm and definitive offer to purchase the product indicated on the Internet Site. Once definitively validated by the Customer, this Order cannot be withdrawn by the Customer, the decision of acceptance or refusal belongs solely to IDH.

IDH will be free to accept or refuse, without giving reasons, any order from a customer. IDH will communicate its decision of acceptance by an email sent to the address indicated by the customer (order confirmation) or by the confirmation of the dispatch of the goods (delivery note).

Article 4: Sales prices

IDH reserves the right to modify its sales prices at any time, but undertakes to apply the prices displayed at the time of the Order. 

The prices indicated are in Swiss francs and include all taxes (VAT, third-party fees). Delivery costs are included in the price. 

The prices indicated are only valid in Switzerland and the Principality of Liechtenstein.

Article 5: Payment in advance and security 

The Customer’s offer to order a product from IDH implies an advance payment of the amount of the Order.

Payment in advance is made on the secure bank or postal servers of IDH’s partners, as proposed on the Internet Site. This implies that no banking or postal information concerning the Customer passes through the IDH sites. Payment by bank or postal card is therefore perfectly secure.

The order shall be recorded and validated as soon as the payment is accepted by the payment system chosen by the Customer. The Customer’s Order shall be validated and the Customer’s card shall be automatically debited when the Order is registered.

The Customer must complete the Order form offered on the Website before being able to validate it. The Customer’s credit card or Postcard details are encrypted using the SSL (Secure Socket Layer) protocol and are never transmitted unencrypted over the network. Payment in advance is made directly to the bank or post office. The card number is not sent to IDH.

The risk of a malfunction of the payment system is borne by the Customer.

Article 6: Delivery terms and deadlines

The products are delivered to the delivery address indicated by the Customer in the Order. The risks associated with sending the goods to the Customer (risk of loss, destruction, wrong delivery address, etc.) are borne by the Customer as soon as the goods are handed over by IDH to the carrier designated by IDH. In the event of an error in the recipient’s details, IDH cannot be held responsible for the impossibility of the carrier to deliver the product. 

The costs inherent in the return of an unclaimed shipment and its possible reshipment are at the expense of the customer. Before any reshipment, IDH can ask the customer to pay the related costs beforehand.

In the case of an unclaimed shipment, IDH cannot be held responsible, including in the case where the post office does not leave a delivery notice. The return costs and the risks inherent to this transport are at the charge of the Customer.

In the event that a shipment is returned to IDH’s premises due to the impossibility of delivery (postal deadlines exceeded, incorrect recipient address, etc.), the Customer is automatically informed by an e-mail sent to the address indicated in the Order. If no news is received from the Customer within 3 months of the email being sent, IDH reserves the right to cancel the order. In such a case, IDH is released from its obligation to deliver the goods and the advance payment made by the customer to IDH at the time of the order will be retained by IDH as contractual damages, this being in settlement of all accounts and all claims for the Order in question.

All items are normally dispatched within 5 working days (weekends and public holidays are excluded from this timeframe). The times indicated are average times and correspond to the processing, preparation and dispatch times for all Orders (ex-warehouse).

In the event that IDH is unable to deliver the goods ordered within 20 days (date of leaving the warehouse), the Customer can cancel the Order by sending an email or a letter to IDH’s customer service department mentioning the references of the Order. This cancellation will only be taken into account if it reaches IDH 24 hours before the delivery of the goods ordered to the carrier designated by IDH. Otherwise, the order cannot be cancelled. The cancellation must also be received by IDH within 30 days of the order.

In the event of a valid cancellation, the advance payment made by the customer at the time of the order will be reimbursed to the customer in full and for all claims. The customer cannot in any way claim additional damages from IDH, his claims being limited exclusively to the full return of the advance payment.

IDH is also entitled to cancel an order, even if it has been accepted, without having to give reasons to the customer. In such a case, the customer’s claims against IDH are limited to the return of the advance payment, to the exclusion of all damages.

Upon receipt of the Order by the Customer, the Customer shall immediately inspect the goods delivered.

In order to identify apparent defects (packaging defect, product delivered not corresponding to the product ordered, possible missing product, etc.), the Customer must check the conformity of the goods delivered before opening them. He must immediately indicate, by e-mail, the defect found and wait for the indications of IDH for the continuation of the treatment.

Article 7: Responsibilities

IDH is only liable for direct damage which the customer proves to be caused by gross negligence on the part of the company or an authorised third party. Liability for slight negligence or simple negligence is excluded.

In the event of liability on the part of IDH, this is limited to the price of the product delivered or the service provided. Any further liability of IDH, its agents or third parties commissioned by IDH for damages of any kind is excluded. In particular, the customer has no claim for compensation for damages that do not affect the product itself.

The choice and the purchase of a product are placed under the sole responsibility of the Customer. The total or partial impossibility of using the products, notably due to incompatibility of the equipment, cannot give rise to any compensation, reimbursement or questioning of the responsibility of IDH.

In any case, any claim for damages shall be limited to the maximum amount corresponding to the price paid by the Customer at the time of the Order.

Article 8: Guarantee – limitation of guarantee – return procedure

The Guarantee for hidden defects is limited to a maximum of one month (from the date of departure from our warehouse). Beyond this period, IDH will not accept any claims. The existence of a longer manufacturer’s warranty is reserved (see chapter 9 below).

Before returning a product purchased due to a defect or non-conformity covered by the IDH warranty, the Customer must make a prior request to the IDH Customer Service within 3 days of the discovery of the defect and obtain from the said service a return number (RMA) and indications on the procedure to follow for the return. 

No returned goods will be accepted if they are not in their original packaging or if the return of the goods has not been preceded by an RMA request to IDH’s customer service.

As soon as the RMA is received, the Customer has 5 days to return the defective product to IDH. After this period, all returns will be refused. The return must be made in a registered parcel, with the Customer bearing the risks and costs associated with this return.

For defective products returned by the customer in accordance with the procedure provided for in this chapter, IDH’s obligations are limited, at IDH’s sole discretion, to

  • or to replace the product by standard exchange or by the supply of an equivalent product;
  • or reimburse the Customer the amount paid at the time of the order.

Article 9: Right of return

In Switzerland the right of return does not exist, any order placed is therefore firm and final. If you wish to return an item you must first request authorisation from IDH by sending an email to info@idhswiss.ch, including the reference Order number as well as the reasons for requesting the return. In the event that IDH grants you this right, only goods in perfect condition and in their original packaging will be accepted. As soon as these conditions are met, IDH will reimburse the Customer the full amount concerned, with only the cost of reshipment to be borne by the Customer.

Article 10: Manufacturer’s warranty

When the product benefits from a manufacturer’s warranty, this is indicated on the article sheet on the site. The manufacturer’s warranty is generally one year for parts. It is up to the Customer to find out the extent of the manufacturer’s warranty.

In the event of a defect under warranty during the manufacturer’s warranty period, repairs will be carried out by the national network of technical centres, stations or agencies approved by the manufacturers, at IDH’s full discharge, according to the conditions proposed by each manufacturer, to the exclusion of all liability of IDH.

In order to benefit from the product guarantee, it is essential to keep the purchase invoice of the product. 

Article 11: Obligations of the Customer

The Customer undertakes to use the purchased product in accordance with the manufacturer’s instructions and to carry out the necessary maintenance recommended by the manufacturer in order to ensure its proper functioning.

The Customer must keep the invoice, the original packaging and all manuals and accessories relating to the product purchased. These may be requested in the event of a warranty repair.

Article 12: Data protection

By registering on the IDH website, the customer expressly agrees to receive information of an advertising or other nature from IDH. The customer can unsubscribe at any time, easily and free of charge, by following the instructions in the respective message or by contacting the IDH Customer Service.

IDH only passes on personal data to third parties insofar as this is necessary for the proper execution of the Order.

IDH reserves the right to analyse all data collected and to use information on purchasing behaviour in an anonymous form for marketing purposes.

IDH is entitled to delete a registered customer from its computer files at any time, i.e. to terminate the registration with immediate effect, without having to justify its decision, without notifying the customer and without the registered customer in question being able to make any claim against the company. This applies in particular to registered customers who violate these general terms and conditions.

Excluded registered customers are not allowed to re-register as registered customers on the IDH websites, either under their own name or another name, without the prior consent of IDH.

Article 14: Applicable law and jurisdiction

The present contract, as well as the sales organised by IDH, are governed by Swiss law. In the event of a dispute, the place of jurisdiction is exclusively that of IDH’s registered office, with the right of appeal reserved.

The general terms and conditions of IDH are written in different languages, in case of contradiction, only the French version is valid.
